Terms of Service

Welcome to FOB (Fresh Off the Boat). These Terms of Service ("Terms") are an agreement between you and FOB Social Inc. (British Columbia, Canada) ("FOB", "we", "us"). By creating an account or using FOB you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use FOB.

1. Who can use FOB

FOB is for adults only and has zero tolerance for child sexual abuse and exploitation. Read our Child Safety Standards.

  • You must be at least 18 years old (or the age of majority where you live, if higher).
  • You may only have one account, and it must be about you: your real first name, age, photos and details.
  • You may not use FOB if you have been convicted of a violent or sexual offence, or if we have previously removed your account.

2. Your safety

FOB helps people meet, but we do not run criminal background checks or verify the identity of every member. You are responsible for your own interactions. Meet in public places, tell a friend where you're going, and never send money to someone you've met on FOB. If someone makes you feel unsafe, unmatch them and contact us. In an emergency, call your local emergency number.

3. Community rules

FOB is a welcoming place for people from every background. You agree not to:

  • harass, threaten, bully, stalk or intimidate anyone;
  • post hateful content or discriminate against anyone based on race, ethnicity, national origin, religion, gender, sexual orientation, disability or immigration status;
  • post nudity, sexual content, violence, or anything illegal;
  • impersonate anyone or use photos that aren't you;
  • ask for money, promote businesses, or send spam or scams;
  • share anyone's private information without their permission;
  • use bots, scrape the service, or try to break its security.

We may remove content or suspend or close accounts that break these rules, with or without notice.

4. Your content

You own the photos and text you post. You give FOB a non-exclusive, worldwide, royalty-free licence to host, display and process that content only so we can run and improve FOB. This licence ends when you delete the content or your account, except where others have already seen it or we must keep it by law.

5. FOB Pro and payments

  • FOB is free to use. FOB Pro is an optional monthly subscription (CA$9.99, charged in Canadian dollars plus applicable taxes; we may show an estimate in your local currency) with extra features.
  • Subscriptions renew automatically until you cancel. You can cancel at any time and keep Pro until the end of the period you paid for. Subscriptions bought in the App Store or Google Play renew unless cancelled at least 24 hours before the end of the current period, and are managed and cancelled in that store's account settings; refunds for them are handled by Apple or Google under their policies.
  • FOB Pro belongs to your FOB account, so it works on the website and in the phone apps wherever you sign in.
  • Except where required by law, payments are non-refundable.
  • We may change prices or features with notice before your next renewal.
  • Founding member offer: the first 50 members who create an account and complete their profile with at least one photo receive FOB Pro free for 12 months. The offer has no cash value, can't be transferred, and ends if the account is closed for breaking these Terms. When it ends, your account returns to the free plan unless you choose to subscribe.

6. Ads

FOB may show ads to members on the free plan in the future. FOB Pro members won't see ads.

7. Ending your account

You can delete your account at any time. We may suspend or close your account if you break these Terms, if required by law, or to protect other members.

8. Disclaimers

FOB is provided "as is". We don't promise that you'll find a match or a friend, that the service will always be available or error-free, or that other members are who they say they are.

9. Limitation of liability

FOB is not responsible for what other members say or do, on or off the app, or for indirect losses (for example lost time, lost opportunities, or emotional distress) that come from using FOB. If FOB is ever found responsible for something, the most we can owe you is what you paid us in the 12 months before the problem, or CA$100 if you paid nothing. This is a cap on what you could claim, not a payment. Some laws don't allow these limits, and nothing here takes away rights those laws give you.

9a. Reports and safety review

When you report a person or conversation, you agree that FOB's safety team may read that conversation to review the report. We only do this for reported conversations, and only to keep members safe.

9b. Photos and GIFs in chats

You may share photos and GIFs in chats. Don't share nudity, sexual content, violence, or anything you don't have the right to share. We may remove shared media and close accounts that break these rules, and we report illegal content to authorities when the law requires it.

9c. Events

Events shown in the calendar are run by third parties, not FOB. Check details with the organiser before you go. Pro members who list events must have the right to promote them and must give accurate details. Listing fees are charged when payment is available, and are non-refundable once the listing is live, except where the law requires. FOB may remove any listing. Reviews must be honest and about your own experience.

10. Changes

We may update these Terms. If a change is significant, we'll tell you in the app before it takes effect. Continuing to use FOB after that means you accept the new Terms.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, unless the law where you live says otherwise.
